| 1. Application of the Terms of
Use These terms (Terms) together with any additional terms, conditions and disclaimers contained in the written agreement between you and AAP governing your use of the AAP NewsPlus Service (AAP Corporate NewsPlus Agreement ) form the conditions of supply of content on, use and access to the AAP NewsPlus Web Site and the AAP NewsPlus Service. Your use of the AAP NewsPlus Web Site and the AAP NewsPlus Service constitutes your acceptance of these Terms. 2. The AAP NewsPlus Web SiteThe AAP NewsPlus Web Site is operated by Australian Associated Press Pty Ltd and its related bodies corporate (collectively AAP). 3. Use of Content included on the News Plus Web SiteThe copyright in the information provided through the AAP NewsPlus Service is either owned by or licensed to Australian Associated Press Pty Ltd. You may not use this information for any purpose or in any medium or format unless you or your organisation have a signed AAP Corporate NewsPlus Agreement in place with Australian Associated Press Pty Ltd and strictly adhere to the terms of such agreement. For the avoidance of doubt, all information (including, without limitation, edited, abridged or rewritten versions of this information), text and images included as part of AAP NewsPlus Service is for personal use only and may not be re-written, copied, re-sold, republished, re-disseminated or re-distributed (including, without limitation, via the Internet or World Wide Web), framed, linked or otherwise used whether for compensation of any kind or not, without the prior written permission of AAP. 4. Accuracy of contentThe AAP NewsPlus Web Site, the AAP NewsPlus Service and content included on them are published for information purposes only without assuming a duty of care. If the law, including the Trade Practices Act 1974 (Cth) (as amended) or any similar legislation, implies or imposes a non-excludable condition or warranty which can be limited, the liability of AAP to you for breach of that condition or warranty will be limited - as AAP determines to:
(a) supplying the service again;or In no event will AAP or any licensor to AAP be liable to you or third parties for any indirect, consequential, special or incidental damages in respect of the AAP NewsPlus Service, the AAP NewsPlus Web Site or any act or omission on its part in relation to its obligations under these Terms including, without limitation, payments to third parties, loss or revenue, profits, goodwill or data however caused, whether or not: (a) such loss or damage was foreseeable or
contemplated by either party; and
In the event that AAP breaches any provision of these Terms, AAP’s liability will in all circumstances be limited to the amount specified in the AAP Corporate NewsPlus Agreement. 6. CopyrightUnless otherwise stated, AAP reserves all copyright in the content and design of the AAP NewsPlus Web Site and the information contained in the AAP NewsPlus Service. AAP owns all such copyright or uses it under licence or applicable law. You may view the AAP NewsPlus Web Site, the AAP NewsPlus Service and their content using your web browser for your personal use only. 7. Trade marksThe AAP NewsPlus WebSite and the AAP NewsPlus Service include registered and unregistered trade marks, including but not limited to the word AAP, the AAP logo, AUSTRALIAN ASSOCIATED PRESS and AAP NEWSCENTRE. You may not use any of AAP's trade marks or the names 'Australian Associated Press Pty Ltd' or 'Australian Associated Press' without first obtaining AAP's prior written consent. 8. PrivacyAAP will collect and use personal information in accordance with AAP's privacy policy http://www.aap.com.au/privacy-policy. 9. Applicable lawThese Terms will be governed and construed in accordance with the laws of the state of New South Wales, Australia.
